This is an appeal from the Circuit Court of Madison County wherein the appellee filed a complaint to obtain specific performance of an alleged oral contract to make a will. By agreement of the parties, the cause was submitted for trial to the court upon the appellees second paragraph of supplemental complaint and the appellants answer in denial. This supplemental complaint contains eleven lengthy paragraphs, and, in order to be brief, we will condense the averments contained therein.
